The legal basics for using Simply Optical, in plain language wherever we could manage it.

Terms of Service

1. Who this agreement is with

Simply Optical is provided by [Cade Kowallis / your legal business name, e.g. "Simply Optical LLC" — fill in once your business is formally set up] ("Simply Optical," "we," "us"). By downloading, installing, or using Simply Optical, you ("you," "your practice") agree to these terms.

2. What you're getting

Simply Optical is a downloadable, browser-based optical quoting application. It runs entirely on your own computer(s) — there is no cloud service, hosted account, or server component that stores your practice or patient data. A subscription grants your practice a license to install and use the application; it is not a sale of software, and we retain all ownership and intellectual property rights in Simply Optical.

New downloads include a 30-day free trial with full functionality and no credit card required. No charge occurs unless and until you actively subscribe.

5. Billing

Subscriptions are billed in advance through our payment processor, Stripe. Prices may change with at least 30 days' notice to active subscribers before the change applies to their next billing cycle.

6. Cancellation

You may cancel at any time by emailing hello@simplyoptical.net. Canceling stops future billing; you keep full access through the end of the period you've already paid for. See the Cancellation & Refunds section below for details.

7. Your data and HIPAA

Simply Optical does not transmit, store, or have access to any patient information you enter into the application — everything stays on your own computer(s) in your browser's local storage. Because we never receive, access, or maintain patient data or other protected health information, Simply Optical does not act as a HIPAA "business associate," and we do not enter into Business Associate Agreements. Your practice remains solely responsible for its own HIPAA compliance, including how it handles, backs up, and secures the computers Simply Optical runs on.

8. Your responsibility for backups

Because your practice's pricing, insurance plan setup, and saved quotes live only in your browser's local storage, clearing browser data, switching browsers, or replacing a computer will remove them unless you've exported a setup backup file (Practice Settings → Export setup file). We recommend exporting a backup periodically and after any significant setup changes.

9. No warranty

Simply Optical is provided "as is," without warranties of any kind, express or implied. We do not guarantee the application will be error-free or uninterrupted, and pricing/benefit calculations should always be verified against your actual insurance contracts — Simply Optical is a quoting aid, not a guarantee of coverage or payment from any insurer.

10. Limitation of liability

To the maximum extent permitted by law, Simply Optical's total liability for any claim arising from your use of the application is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data.

11. Changes to these terms

We may update these terms from time to time. Material changes will be communicated by email to active subscribers. Continued use after a change takes effect means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the State of [Your State], without regard to conflict-of-law principles.

What we collect

We collect two categories of information, and they're kept separate:

What we don't collect

Simply Optical, the application itself, does not transmit any data to us or anyone else. Patient names, insurance details, quotes, and everything else you enter while using the app stays on your own computer, in your browser's local storage. We have no server, database, or account system that patient data ever reaches. This website does not use analytics or advertising cookies.

How long we keep signup information

We retain your signup and billing contact information for as long as you're an active subscriber, plus a reasonable period afterward for our own business records (e.g., support history, billing history). You can ask us to delete it by emailing hello@simplyoptical.net, subject to what we're required to keep for accounting purposes.

Your choices

You can ask us at any time (hello@simplyoptical.net) to tell you what contact information we have on file, correct it, or delete it.

Cancellation & Refund Policy

Because every new subscription starts with a full 30-day free trial — no credit card required — you have a complete, no-risk opportunity to try Simply Optical before paying anything. For that reason, subscription payments are generally non-refundable once billing begins.

Cancellation

Cancel anytime by emailing hello@simplyoptical.net. You'll keep access through the end of your current paid period (the rest of the current month if billed monthly, or the rest of the current year if billed annually) — no partial-period refund is issued for the time remaining.

Exceptions

If you believe you were billed in error (e.g., a duplicate charge, or a charge after you'd already canceled), email hello@simplyoptical.net and we'll make it right. We may also issue a refund at our discretion in other extenuating circumstances.
